Injuries Caused by Health Care Providers

Sensitive advocates for medical malpractice cases

Medical malpractice is the failure of medical professionals to provide adequate treatment to patients.  The result can be a personal injury or substantial loss of income.

If you or a loved one suffers harm from medical error or a mistake, legal remedies can include monetary damages for future medical care and treatment, lost wages, lost future earnings, and pain and suffering.

In New York, medical malpractice lawsuits must be filed within two to five years of when the mistake was made.  New York does not cap the amount of damages recoverable in medical malpractice cases.

Medical malpractice can be devastating to you and your family.  The harm caused varies in severity and victims can be at any stage of life.

Our attorneys have intricate understanding of the interplay between medical and legal issues in these types of cases:

  • Birth Injury. The many possible causes for birth injuries include breech delivery, delayed cesarean section, failure to notice fetal distress, placenta abruption, and medical negligence.

As a result of a birth injury, an infant may be afflicted with mental retardation, cerebral palsy, Erb’s palsy, epilepsy, and autism.

If your baby suffers a serious birth injury, the law may provide for past and future medical expenses, pain and suffering, as well as long-term care needs for your child. The blame may fall with more than one health care provider.
  • Erb’s Palsy.  Also called brachial plexus paralysis, it occurs during delivery due to the baby’s poor birthing position. The damage happens when a doctor applies too extreme a force when releasing the baby’s shoulder. The shoulder and related nerves can be injured resulting in a limp arm and loss of muscle control in the arm, wrist, and/or fingers.
  • Cerebral Palsy.  During childbirth,,a baby's brain may not get enough oxygen because of trauma.  The baby can sustain permanent injuries such as cerebral palsy or brain damage.
