Taser Victim's Family Sues City, NYPD

 February 25, 2009—At 9:30 a.m. this morning, February 25, 2009 a Summons and Verified Complaint will be filed in the Office of the Clerk, Supreme Court, Kings County in the matter wrongful death of Iman Morales. The Complaint is being filed against the City of New York, P.O. Nicholas Marchesona, and Administrator of the Estate of LT. Michael W. Pigott.

Iman Morales was improperly tasered on September 24, 2008 by members of the New York City Police Department.  The improper taser of Mr. Morales resulted in his death on the same day. 

            A press conference with Mr. Morales’ family will be held at the offices of Burns & Harris located at 233 Broadway, Suite 900, New York, New York at 12 noon this morning.  No access will be granted for set up prior to 11:30 a.m.

            February 24, 2009--Trial in the case of People v. Cardoza  came on before Acting Supreme Court Justice George R. Villegas on February 23, 2009 in Supreme Court, Criminal Term.  After hearing the People’s case with Police Officer Steven Tamala, the Judge granted defendant’s motion to dismiss based upon the fact that the People failed to make out a prima facie case.  An additional misdemeanor charge was dismissed prior to trial.

               Despite being provided with video evidence demonstrating no culpable conduct on behalf of Mr. Cardoza, the Bronx DA Office chose to go to trial even after requesting Mr. Cardoza’s cooperation to facilitate a prosecution against the police officers.

              The video of the beating by Officer Mendez and Perez was identified by Officer Tamala as the two officers most directly responsible for beating Mr. Cardoza. Mr. Cardoza spent a week in the hospital having his arm surgically repaired while handcuffed to his hospital bed.
